What to do if employer did not pay health insurance?

I have a friend who was recently let go from an employer because the company was not doing well and the owner had to reduce the labor. She was the ranking FNG (frickin' new guy) so she and the other most junior employee got the axe. They didn't get their last paychecks so she was working for free for the last 2 weeks. Then she went to get COBRA, she discovered that the employer had not been paying the health insurance premiums even though the money had been being deducted from her checks. What sort of recourse is this for this? Would it even be worth getting an attorney?
