Are businesses required to put up a fence if they are next to a residence?

As others have stated, this would be determined by LOCAL codes. If it is not required, which I doubt if they don't have a fence, you could offer to share the cost of a fence with them. If it is required, report the violation to the local code enforcement, and they will save you the cost of an attorney.
