Damage to my lawn on purpose by neighbor?

She may think the 12 inches belong to her (on your side of the fence) but doe's it really?Have you been paying the tax on it. You could charge her for lawn maintenance for as long as you have owned your property, if it isn't her property.City hall has a property description of property lines. The property deed will also tell you where the property line is..I'm sure she was angry with your husband but she was also very wrong in coming onto your side of the fence and using a chemical to kill your grass. Do you have small children who play on the grass? Or animals who could become ill? Small claims court would be your best way to recoup what you are out in restoring the strip of property she ruined. Destroying a neighbors property is also against the law.File a civil report with the police and don't believe what she says about 12 inches till you see it in writing from city hall..Do not pay for the fence yet.You should also obtain an estimate to repair the damage the tractor did to the fence to show the difference in estimates. $190- sounds obscene for a small section of chain link.Unless the posts are uprooted or it is a gate. .In small claims court the judge will deduct any amount owed to her, from the amount she owes you .Have a landscaper give you an estimate to dig the ground up and replant with new sod.$$$.Take pictures of the damage now and have it dated.Bring all your evidence to court. And if she doesn't show up you win by default..BTW The side of the fence that you can see belongs to you You can hang an ugly tarp, blanket or whatever you want on your side of the fence. .Even if she paid for it entirely.
