Filing a Contempt of Court for misrepresenting documents.?

I am the plaintiff and I servered the defendant attorney with a notice of deposition. The day before the depo at the very last minute he served me with a Motion to Quash. The problem is that he did not and had no intention to serve the court. I objected to his notice at the time because the reasons he gave was untrue, misrepresented and I had already arranged for the depo to be taken. This is a very serious offense on the part of an attorney with thirty plus years of pratice. When I asked him why he did serve the court he replied because his client had not paid him. We I do not cost to file a Quash unless its e-filed than its just a few bucks. I firmly believe he did not think I would find out. Please what are my options and what kind of recourse do I have.
